History

Wellman & Nichols, PLLC  was created in 2008 by combining the established insurance defense practices of Dean Wellman and  Mark Nichols.  Attorneys Carl W. Walter II and Jeff Rager became associated with the firm in 2009.  In 2010, Ken Smith, an experienced litigator with a reputation for trying cases sucessfully,  joined the firm and Wellman, Nichols & Smith, PLLC was created.   Joining the firm with Ken Smith were attorneys, Tonya Rager and  Hans Herklotz. 
Together, the three partners of the new firm bring over 75 years of experience in the insurance defense practice throughout Kentucky and portions of Tennessee.  While most of their practice has involved the defense of physicians, nurses and hospitals in medical malpractice actions, they have sucessfully handled a wide variety of other cases as well. 
 Mary E.Canady, an experienced nurse paralegal, and Ginger Cook, a PACE certifed paralegal are also  full time staff members as well.

CaseWins

Trials:

-Defense verdict obtained in medical malpractice action against ER physician and Hospital for failure to diagnose penetrating chest injury and retained foreign body resulting in a subsequent stroke.

-Defense verdict obtained in medical malpractice/wrongful death action against a nurse practitioner relative to diagnosis and treatment of three year old child in the ER.
